This Privacy Policy applies to www.BusinessCreditandCapital.com (the “site”) owned and operated by Business Credit & Capital Ltd. (“Business Credit & Capital”) and to your application for, access to, or receipt of products and services from Business Credit & Capital. Business Credit & Capital is committed to keeping your personal information confidential and secure. This Privacy Policy describes how Business Credit & Capital collects, uses, protects, shares, and retains your information. It also describes the choices available to you regarding the use of, your access to, and how to update and correct your personal information.

Scope and Definitions

This notice describes the privacy practices of Business Credit & Capital and its subsidiaries and affiliates. “We” and “us” means Business Credit & Capital, our subsidiaries and affiliates, and any of our respective agents and third party service providers (“service providers”). “You” means a website visitor, applicant, customer, former customer, an owner of, or reference or guarantor for, an applicant.

Personal information means any factual or subjective information in recorded form that identifies or could be used to identify an individual.

Our Relationship with Advance Funds Network

Business Credit & Capital is affiliated with Advance Funds Network LLC (“AFN”), a U.S.-based business-funding company. Because we are affiliated, we may share your personal information with AFN, and AFN may share your personal information with us, for the purposes described in this Privacy Policy, including assessing your eligibility for funding products and offering you products and services that may be of interest to you. In particular, if your application to Business Credit & Capital is declined or cannot be fully served by us, we may refer your application and the information and documents you provided to AFN (and AFN may refer declined or unserved applications to us) so that an affiliated funding option can be considered. AFN handles personal information in accordance with its own privacy policy, which is governed by United States federal and state privacy laws. If you do not want your information shared with AFN for these purposes, please contact our Privacy Officer using the information at the end of this Policy.

Collection of Personal Information

By submitting your personal information to Business Credit & Capital or our service providers and agents, you agree that Business Credit & Capital may collect, use, and disclose such personal information in accordance with this Privacy Policy. If you apply for Business Credit & Capital products or services, the application and any terms and conditions specific to your account may also describe additional purposes for which we collect, use, disclose, and retain personal information.

The personal information that Business Credit & Capital collects and uses varies depending on our interactions with you. Our objective when collecting and using personal information is to maintain and improve the relationship we have with you, provide you with information about products and services that you will value, reduce the cost associated with maintaining your (and others’) accounts so that we may continue to provide you with a fairly priced product, reduce unwanted or inappropriate marketing, and protect you from unauthorized access to and use of your account or personal information.

The personal information that we may collect from you includes:

  • Contact and identifying information such as name, email address, mailing address, phone number, and date of birth. Where required for credit reporting, tax reporting, or identity verification purposes, we may also collect your social insurance number or other government-issued identification. We collect a social insurance number only where permitted or required by law or with your consent.
  • Billing information such as credit card number, bank account number, void cheque, and billing address.
  • Information about your business such as company name, entity type (e.g. corporation, partnership, sole proprietorship), and business phone number.
  • Information about your relationship, such as whether you are a contact, reference or guarantor for an applicant.
  • Credit information about you and your business.
  • Financial information about you and your business, such as sales volume, revenue, seasonal or cyclical income patterns, and online banking credentials where you apply for a service that offers data collection directly from your bank account.

By submitting information about other individuals, such as references, guarantors, landlords, emergency contacts, other owners or employees, you warrant and represent that you have obtained their consent to the collection, use and disclosure of their personal information in accordance with this Privacy Policy. This consent includes the use of individuals’ contact information to verify information you have provided to us and their express consent to receive commercial electronic messages from Business Credit & Capital.

We may collect personal information from multiple sources, including:

  • From you, in an application, agreement, form, correspondence, or verbal communication.
  • From third parties such as credit bureaus, business directories, direct contact with nearby businesses, online searches, financial institutions and other entities that have extended credit to you.
  • From other people or entities you have identified, such as references (including landlords, suppliers and franchisors), guarantors, employees or directors of your company.

We limit the collection of personal information to what is necessary for the purposes identified in this Privacy Policy. We collect personal information by fair and lawful means and, except where permitted or required by law, only with your knowledge and consent.

We may collect personal information at various times, including:

  • Before we have a business relationship, such as when you send us correspondence, make an inquiry about our products and services, submit an application, or after an application has been declined by us or withdrawn by you.
  • During our business relationship, such as when your application and eligibility is being assessed, and during the term of any products, services or other agreement between us.
  • After our business relationship, including to assess your eligibility for new or additional products or services, maintain internal records and communication with you, and to analyze and improve our processes, products and services.

Use of Personal Information

We use personal information about you to:

  • Evaluate, monitor, maintain, service, and collect any application or account you may have with us, including disclosing or exchanging personal information with credit reporting agencies;
  • Develop our relationship with you, and to offer financial products and services, including evaluating the needs, wants, and satisfaction levels of customers, potential customers, former customers and others who engage with us, and analyzing and managing our business;
  • Administer services, monitor your purchases, transactions, payments, and evaluate your credit eligibility before, during and after our business relationship, for the purposes set out in this Privacy Policy;
  • Verify your identity (or that of any authorized user or co-applicant) concerning the account and maintain security measures aimed at the detection and prevention of fraudulent activity in relation to your account;
  • Promote and market products and services offered by Business Credit & Capital, including both products and services which are directly related to your account (such as balance transfers and alternative payment methods) and those that are separate from your account, and including by means of direct marketing;
  • Establish and maintain communications with you, and respond, report or discuss information in response to product and service inquiries or suggestions for improving our products and services;
  • Meet legal and regulatory requirements; and
  • Carry out everyday business purposes, such as website management, research and product and service development.

Use of Credit Information

Credit score and related information is central to most of the financing products and services that Business Credit & Capital provides. As a result, the collection and use of credit information is required in order to apply for or maintain our products. In order to offer competitively priced products, we collect and analyze credit information about applicants and customers before, during and after the term of our business relationship, both to assess your eligibility for products and to improve our overall risk assessment tools.

Business Credit & Capital may collect and use credit information at multiple points throughout the term of the business relationship, and may continue to collect and use updated information after that relationship has ended, for the purposes described above. If you do not want your credit information to be used by Business Credit & Capital after the term of our business relationship, please contact us using the information provided below.

Automated Decision-Making and Your Right to Human Review

To assess applications efficiently and consistently, Business Credit & Capital may use automated processes, including credit-scoring models and other algorithmic risk-assessment tools, to evaluate your eligibility for our products and services. In some cases, a decision about your application may be based in whole or in part on the automated processing of your personal information, including credit and financial information collected from you and from third parties such as credit bureaus.

Where a decision that produces legal or similarly significant effects for you is made using automated processing, you have the right to be informed of that processing and, on request, to obtain the following: the personal information used to make the decision; the reasons for the decision and the principal factors that led to it; and information about your right to have the personal information corrected. You may also request that the decision be reviewed by a member of our staff, and you may submit observations for us to consider. Use of Your Email Address

We use both Business Credit & Capital servers and servers of other service providers to deliver and report on the progress of e-mail programs and to maintain service and fulfill products and services. When Business Credit & Capital uses a service provider, we prohibit them from using your e-mail address for any other purpose.

We send commercial electronic messages in compliance with Canada’s Anti-Spam Legislation (CASL). We will send you commercial electronic messages only where you have given your express consent, or where we are permitted to rely on implied consent under CASL (for example, because of an existing business relationship). Every commercial electronic message we send will clearly identify Business Credit & Capital, provide our contact information, and include a working unsubscribe mechanism that allows you to withdraw your consent at no cost. We will give effect to any unsubscribe request promptly and, in any event, within the time required by law.

If you are a customer, we may also use the e-mail address you provide to send you messages about your account that are not commercial electronic messages, such as activating your account(s), account past-due notices, available rates, and adding an authorized user. You may not opt out of these account-related communications while you have an active account with us, as they are necessary to administer your account.

We will track the activity of an e-mail (for example, whether graphics were viewed, whether the e-mail was opened, and whether links in the e-mail were clicked) to allow us to measure the effectiveness of the e-mail, to provide future offers, and for fulfillment of products and services. Additionally, for your convenience, we may pre-fill online forms with your e-mail address.

Sharing Personal Information

We will share your personal information with third parties only in the ways that are described in this Privacy Policy and other terms included in applications or agreements with you. Further, we share only the personal information we believe is needed to offer a product or service efficiently or to improve such product or service.

We may provide your personal information to our service providers, who may be located outside Canada, for purposes related to supporting our business (e.g., sending you emails, fulfillment services, technical support, delivery services), including, without limitation, research and product and service development. These third parties are authorized to use your personal information only as necessary to provide these services to us.

We may also disclose your personal information:

  • to credit bureaus, references, guarantors and other third parties that require it in order to identify you, to provide Business Credit & Capital with information about you, to facilitate the credit reporting system, to collect on accounts, to provide products or services to you or to assess your eligibility for those third parties’ products or services, or to meet legal and regulatory obligations;
  • to third parties who offer products or services that may be of interest to you, where you have consented to this disclosure; you may decline or withdraw this consent at any time by contacting our Privacy Officer;
  • as required by law, such as to comply with a subpoena, bankruptcy proceedings, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • in response to lawful requests by public authorities, including to meet national security or law enforcement requirements;
  • to third parties (who may be located outside of Canada) if Business Credit & Capital is involved in a merger, acquisition, or sale of all or a portion of its assets, in which case you will be notified via email and/or a prominent notice on our website of any change in ownership and uses of your personal information; and
  • if the rights or property of Business Credit & Capital, its affiliates, subsidiaries, or third party service providers are in jeopardy.

In addition, Business Credit & Capital may create, use and disclose anonymized and/or aggregated information which does not allow you to be personally identified to third parties.

Sharing Personal Information Outside of Canada

Some of the third parties, service providers, affiliates or related companies that may collect, use, store or process your information are located outside of Canada, including in the United States, where our affiliate Advance Funds Network operates. As a result, your personal information may be transferred to, stored in, and/or processed in the United States and other countries in connection with the purposes described in this Privacy Policy.

While your personal information is outside of Canada, it is subject to the laws of the jurisdiction in which it is held. This means that, in certain circumstances, your personal information may be accessed by the courts, law enforcement agencies, regulatory authorities, and national security authorities of those jurisdictions, including under United States laws, and may be disclosed in response to valid legal demands or requests from those authorities. The protections available to your personal information under the laws of those jurisdictions may differ from, and may be less protective than, those available under Canadian law.

Business Credit & Capital remains accountable for personal information that we transfer to service providers outside of Canada for processing. We use contractual and other measures to require that your personal information receives a comparable level of protection while it is being processed on our behalf in another jurisdiction. Before transferring personal information outside of Quebec or Canada, we conduct an assessment of the privacy-related factors associated with the transfer, including the sensitivity of the information, the purposes for which it will be used, the protections in place, and the legal framework of the destination jurisdiction. Retention of Personal Information

We will retain your information for as long as needed to fulfil the purposes for which it was collected and used. In some cases, this may be as long as your account is active or as needed to provide you services. However, in other cases we will retain personal information after the end of our business relationship, including to maintain communications with you, facilitate future applications you may submit, understand customer preferences and behaviours, analyze and improve our processes and develop new products and services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. You should not assume that your information will be deleted when you close your account with us or if an application is not approved. Children’s Privacy

Our site, products, and services are intended for businesses and for individuals who are the age of majority in their province or territory of residence. They are not directed at children, and we do not knowingly collect, use, or disclose personal information from children. If you believe that a child has provided us with personal information, please contact our Privacy Officer using the information at the end of this Policy, and we will take reasonable steps to delete that information unless we are required to retain it by law.

Information Collected Through This Site

The Business Credit & Capital web servers automatically recognize and record the domain name from which you access the Internet, the corresponding Internet Protocol (“IP”) address, and the names of the pages you visit while at Business Credit & Capital’s Site, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data, and store it in log files. This information is used to improve the content of Business Credit & Capital’s Site and make it more useful.

Personal information of users, including emails, is collected when you respond to specific questions and when you communicate directly with Business Credit & Capital via e-mail or feedback forms. Business Credit & Capital may ask you to provide us with your e-mail address at several points, including on applications and in correspondence or communications with you.

Updates and Amendments to This Privacy Policy

This Privacy Policy is effective as of May 1, 2026. This Privacy Policy replaces any previous notices from Business Credit & Capital about personal information collection, protection, use, sharing, retention, and Internet privacy practices, and applies to the use, sharing and retention of personal information previously collected. However, this Privacy Policy does not supersede any application- or account-specific terms and conditions you may have agreed to; those terms must be read together with this Policy.

We may amend this Privacy Policy at any time, and when such a change is made we will post a revised version and a notice on this site.
